Delhi HC declines urgent hearing on plea against AAP’s poll promise

New Delhi: The Delhi High Court on Monday refused an early hearing to a petition objecting to the AAP poll guarantee of a ₹2,100 allowance for women under the Mukhya Mantri Mahila Samman Yojana in the national capital.

Justice Jyoti Singh dismissed the call for an ‘early disposal’ of the petition for January 30, saying there was no sufficient cause for the urgency. She said, “The matter was passed over three times on the last date but the petitioner was unrepresented.” There is no foundation of any hearing made out. Dismissed.”

Counsel for Petitioner Asks for an Early Hearing

The petitioner’s counsel said there was urgency as AAP was still using pamphlets and other material to popularize the scheme among the electorate. Delhi is likely to poll on February 5 although vote counting will take place on February 8.

On the 10 January, the court had said the hearing would be at the end of January due to the absence of the petitioner who once was called three successive times.

Reliability of Petitionauge Challenge

The court had challenged the admissibility of the plea filed by Vijay Kumar as an “election petition.” Kumar said that AAP was only deceived people by promising what they did not have, as the Delhi government had denied the existence of any such scheme.

Shiv Shankar Parashar appearing for the petitioner submitted that the Election Commission of India has been moving on the complaint of his client about the false announcement. He called on the court to order the commission to act on the complaint which was filed on January 3.

Plea Against Form Collection for Non-Existent Schemes

The plea also prayed for a direction to restrain the chief electoral officer from accepting Forms relating to the scheme being filled by AAP workers.

AAP chief Arvind Kejriwal launched the scheme on December 12, 2024, with cooperation from Lieutenant Governor Vinay to enhance the monthly stipend of ₹1000 to ₹2100 if AAP comes into power again in Delhi.

Government’s Public Notice

But, on Dec 25 the Delhi government’s Women and Child Development and Health departments came out with public notices stating that they had not adopted the scheme or another recent free treatment for the elderly pac. These notices advised citizens against disclosing their details; any accumulation of such details was referred to as fraudulent and unauthorized by private persons and political parties.

The reforms have become issues of public debate in the run-up to the February assembly elections.
